Responsibilities
The Anti-Corruption Office at the University of Hamburg has the following responsibilities:
- Fielding allegations of corruption or associated crimes
- Fact-checking allegations for legal relevance
- Forwarding legally-relevant corruption allegations to the appropriate authorities
- Advising relevant offices as well as advising and supervising employees on the topic of corruption
- Determining high-risk areas; the anti-corruption office checks in particular whether existing "internal control mechanisms" are sufficient.
The establishment of the anti-corruption office is based on the agreement set forth in the "General Administrative Regulations on Anti-Corruption Measures (in particular corruption prevention) in accordance with Sec. 94 of the Hamburg Employee Representative's Law of 30 August 2001, in which public servants' existing general advising and support obligations (Sec. 35 in connection with Sec. 33 of the Hamburg Public Service Law ) as related to suspicion of corruption are specified in order to prevent corruption and to provide guidelines for behavior and professional activity. This is also true for employees in the private sector (Sec. 3, paragraphs 1-3 of the Wage Agreement for Public Service in the States, TV-L).
This regulation does not affect the right to bring charges with the appropriate law enforcement agencies.
The anti-corruption office is, like the office of internal auditing, independent and has unlimited access to information although is does not have managerial authority over employees or other offices and institutions of the University.
